Summary

Massachusetts General Laws Chapter 7D § 2 authorizes the Executive Office of Technology Services and Security (EOTSS) to establish statewide IT standards binding on all executive agencies. Under this authority, EOTSS published the Enterprise IT Accessibility Standard requiring conformance to WCAG 2.1 Level AA for all state agency websites and digital services procured or developed after 2018. The standard was updated to reference WCAG 2.2 in 2023. Procurement contracts with the Commonwealth must include accessibility compliance clauses. Enforcement is through the EOTSS standards review and agency IT governance process; no private right of action.
