Summary

Alabama has no comprehensive AI-behavior statute, but has enacted three targeted laws with AI relevance. In 2024 it criminalised AI-generated election deepfakes (Ala. Code § 17-5-16.1, eff. October 1, 2024) and AI-generated child sexual abuse material (Act 2024-98, amending Ala. Code § 13A-12-191 et seq.). In 2026, Governor Ivey signed SB 63 (eff. October 1, 2026), which restricts insurers from using AI as the sole basis for coverage denials and requires human clinician sign-off — Alabama's first enacted AI-specific auto-decision rule. The Alabama Personal Data Protection Act (HB 351, signed April 16, 2026, eff. May 1, 2027) gives consumers an opt-out right for profiling used in solely automated significant decisions, but the legislature stripped explicit AI language from the bill before passage. Multiple chatbot-disclosure, age-verification, and AI-content-labelling bills (HB 324, HB 325, SB 129) were introduced in the 2026 session but did not advance to enactment; Alabama's general unfair-trade-practices statute (Ala. Code § 8-19-1 et seq.) provides the baseline backstop against deceptive AI-impersonation for consumers.
