Summary
Arkansas enacted four AI-related laws during its 2025 legislative session (95th General Assembly), making it one of the more active non-coastal states on AI legislation that year. None of the four enacted laws specifically targets AI crawler behavior, bot disclosure to consumers, or training-data opt-out — the closest is Act 848, which requires all public entities to adopt AI/automated-decision-tool use policies with a human-in-the-loop mandate. The publicity-rights expansion (Act 159) and generative-AI content-ownership law (Act 927) touch the disclosure and agent-transaction space at the margins. The most sweeping proposal — SB 258 (the Arkansas Digital Responsibility, Safety, and Trust Act), which would have regulated high-risk AI systems with automated-decision accountability and non-discrimination requirements — died in committee in May 2025. In the absence of AI-specific private-sector disclosure or bot-transparency law, the Arkansas Deceptive Trade Practices Act (Ark. Code Ann. § 4-88-107) is the operative general-law hook for deceptive automated or AI-generated communications.
