Summary
Michigan has enacted three AI-behavior laws as of mid-2026. The earliest are a package of political AI disclosure and deepfake-election laws (PA 263–266 of 2023, effective February 13, 2024) that require clear disclosure on AI-generated political advertising and criminalize the distribution of materially deceptive AI deepfakes within 90 days of an election. In August 2025 Governor Whitmer signed the Protection from Intimate Deep Fakes Act (PA 11–12 of 2025), criminalizing the nonconsensual creation or distribution of AI-generated sexual deepfakes. Michigan has no enacted law on bot disclosure, automated decision-making accountability, or AI training-data rules; the state's existing Consumer Protection Act (MCL 445.901 et seq.) and Elliott-Larsen Civil Rights Act (MCL 37.2101 et seq.) apply to deceptive AI-generated content and algorithmic discrimination respectively, but neither is AI-specific. A busy 2025–2026 legislative session has produced several active proposals: a Senate-passed children's companion-chatbot safety bill (SB 760), an employer AI monitoring bill (HB 5579), a government AI governing board bill (HB 5899), and a large-model safety bill (HB 4668), all pending in the House.
