Summary

New Mexico has no enacted AI-specific law as of mid-2026. All four AI-related bills introduced across the 2025 and 2026 regular sessions failed: HB 60 (2025, high-risk AI accountability) was postponed indefinitely in February 2025; and HB 28 (transparency of consequential decisions), HB 22 (deepfake images), and HB 141 (generative AI provenance markers, Attorney General-sponsored) all died when the 2026 session adjourned sine die on February 19, 2026 without passing any AI legislation. In the absence of AI-specific statutes, the New Mexico Unfair Practices Act (NMSA 1978, §§ 57-12-1 et seq.) — the state analog to federal unfair and deceptive trade practices law — is the primary general-law hook for deceptive or undisclosed AI practices directed at consumers. Representative Christine Chandler has stated that AI regulation will remain a legislative priority in future sessions.
