Summary

Pennsylvania has no comprehensive AI-behavior statute, but has enacted three targeted laws addressing harmful synthetic media: Act 125 of 2024 (nonconsensual intimate deepfakes and AI-generated child sexual abuse material), Act 35 of 2025 (criminal penalties for digital forgery with fraudulent intent), and Executive Order 2023-19 governing responsible generative AI use across state agencies. The legislature is actively considering several disclosure-focused bills — including the SAFECHAT Act (SB 1090, passed the Senate 49-1, pending in the House) on companion chatbot disclosures for minors, HB 1857 requiring AI disclosure and a right to human review in high-impact consumer decisions, and HB 811 requiring disclosure of AI-generated deepfakes in election campaign ads (passed the House, in Senate committee). For private-sector actors, Pennsylvania's Unfair Trade Practices and Consumer Protection Law provides a general backstop against deceptive AI practices, and the Federal Trade Commission Act applies alongside it. Pennsylvania has not enacted automated-decision-making, AI hiring, or training-data rules.
