Summary
Puerto Rico has enacted one AI-behavior-specific law as of mid-2026: Law 105-2026 (Senate Bill 101), which requires any political advertisement created or modified using artificial intelligence to carry a clear disclosure of its AI origin — a narrow electoral transparency measure, not a general bot-disclosure regime. The Government of Puerto Rico Artificial Intelligence Act (Senate Bill 68), which would establish an AI Officer within the Puerto Rico Innovation and Technology Service, require biennial agency reviews of automated decision-making systems, and create a public registry of businesses using AI in the territory, passed the Puerto Rico Senate on April 7, 2025, but remained pending in the House of Representatives as of mid-2026 and has not been signed into law. Puerto Rico has no enacted law governing private-sector chatbot disclosure, AI web crawling, or training-data use; in those areas, the federal FTC Act Section 5 prohibition on unfair or deceptive acts and practices applies to businesses operating in the territory, including undisclosed automated agents making material misrepresentations to consumers.
