Summary

The Mecanismo Nacional de Prevención de la Tortura (MNPT) was created by Ley No. 9204 (2014) to fulfil Costa Rica's OPCAT obligations, following ratification of the Optional Protocol via Ley No. 8459 (2005). It is an organ of maximum administrative deconcentration, hosted within the Defensoría de los Habitantes but with full functional and substantive independence, headed by an Executive Director. Its mandate is to conduct regular, unannounced visits to all places of deprivation of liberty — including Fuerza Pública cantonal and district delegations, penitentiary centers (Adaptación Social), migrant detention, psychiatric hospitals, and juvenile facilities — inspect conditions, interview detainees privately, and issue recommendations to state authorities. Ley 9204 grants it unrestricted access to facilities and all persons deprived of liberty. Annual reports are submitted publicly. The MNPT does not have discipline authority but operates independently of the agencies it monitors.
