Summary

The Police Ombudsman for Northern Ireland is established under Part VII (ss. 51-65) and Schedule 3 to the Police (Northern Ireland) Act 1998. The Ombudsman is appointed by the Crown on joint recommendation of the First Minister and deputy First Minister for a non-renewable seven-year term (to age 70); removal requires efficiency or conduct grounds with opportunity to respond. The Ombudsman conducts fully independent investigations into complaints against the PSNI; appointed investigators hold full constabulary powers. For non-senior officers, if the Chief Constable declines to bring disciplinary proceedings despite an Ombudsman recommendation, the Ombudsman may direct them to do so (s. 59(5)), making discipline quasi-binding for that tier. Evidence access is full: the Chief Constable must provide all requested information.
