Summary
The National Human Rights Commission (NHRC) was established on 1 August 2020 as a sub-body of the Control Yuan under the Organic Act of the Control Yuan National Human Rights Commission (passed December 2019). Composed of 10 members — the Control Yuan president (chair), seven ex-officio Control Yuan members, and two appointed Control Yuan members — the NHRC investigates torture, human rights violations, and discrimination on its own initiative or via petition (Art. 2). It inherits the Control Yuan's full investigative powers under the Control Act (Arts. 26-29), including access to all government files and records, temporary document seizure, and the ability to compel agency cooperation. Subject domains include law enforcement (police) and corrections/detention facilities. The NHRC engages with CAT/OPCAT NPM standards and publishes thematic and annual human rights reports (Art. 2(3)). Its discipline role is advisory — findings feed into the Control Yuan's corrective-measure and impeachment pipeline rather than binding directly on agencies. Membership is drawn entirely from Control Yuan membership and is not required to be civilian.
