Summary

ZICC was established by the Zimbabwe Independent Complaints Commission Act [Chapter 10:34] (No. 5 of 2022), implementing Constitution s.210. It independently investigates all security service misconduct including deaths in custody, deaths resulting from member actions, and unjustified firearm discharge (s.2 definition of 'misconduct'). Investigators may compel persons to appear, give evidence, and produce documents (s.12(6)); the Commission holds commissioner-of-inquiry powers including summons (s.15(5)). Security services are statutorily required to provide full cooperation and documentation (s.24). Discipline recommendations must be acted on within 30 days (s.17); non-compliance is a criminal offence (s.18). The Chairperson must be judge-qualified; one of four other members must have security service experience, with security service heads appointing non-voting observers (s.6). Annual reports go to Parliament through the President/Minister (s.11).

Jurisdiction scope

Investigates complaints of misconduct against all security service members (police, defence forces, intelligence services, prisons and correctional service); inspects detention facilities; recommends or orders disciplinary action, prosecution, and compensation.
