Requests may be submitted through any means per Article 13.2. Available to any person over 16 years of age (no residency requirement per Article 8.1). No justification required for access request (Article 13.3).

Fees

Article 15 provides that consultation of public information is free. Issuing copies or converting information to a different format may be subject to a public price that cannot exceed the actual cost of reproduction.

Article 11 establishes 13 exemption categories that apply when disclosure would cause harm. All exemptions are discretionary and subject to a harm test. Article 11.2 requires that denials be justified and proportional, with consideration of whether a higher public or private interest justifies disclosure. Article 11.3 provides for severability — partial disclosure is required when only portions of information are exempt. Maximum classification period: 20 years.

Two-tier system: optional administrative appeal to CNAAD followed by judicial review. CNAAD serves as advisory and decision-making body. Administrative appeal deadline is 30 days from notification per Article 129 of Law 14/2023 (Administrative Code).
