Adhesión de Salta a la Ley Nacional de Derecho de Acceso a la Información Pública

Response Timeline

15 business days per national Law 27.275 (incorporated by adhesion). A single 15 business-day extension is permitted with written justification communicated before the initial deadline expires. If the request involves information held by a different agency, the original agency must forward it within 5 business days. Note: As of 2025, Salta has faced criticism for not fully implementing the law — the provincial executive branch had not issued implementing regulations by 2024, and court actions were filed to compel compliance.

Exemptions

• National defense, intelligence, and foreign relations
• Monetary and financial policy information
• Third-party commercial or industrial secrets
• Personal data protected under data privacy law
• Internal deliberative documents (opinions, recommendations)
• Active judicial or administrative investigations
• Attorney-client privileged communications

Exemptions follow national Law 27.275 Art. 8. Human rights violations, genocide, war crimes, and crimes against humanity are never exempt. Partial disclosure applies where only part of a document is exempt.

Appeal Process

As an adhesion law, Salta applies the national Law 27.275 framework including oversight by the AAIP. The province has struggled with implementation — as of 2024, the executive had not issued provincial-level implementing regulations and court proceedings were initiated to force compliance.
