Response Timeline
10 administrative business days from receipt. Exceptionally extendable for 10 additional business days when circumstances make gathering the information difficult. Agency must notify the requester before the initial deadline expires if extending. Once the deadline passes without response or with ambiguous/partial response, a denial is deemed to have occurred.
Exemptions
-
Defense, intelligence, and national security
-
Personal data with no public interest justification
-
Commercial and industrial secrets causing competitive harm
-
Internal deliberative opinions and recommendations
-
Active judicial or administrative investigations
Denial must be ordered by an official of equivalent or higher rank than Program Chief and must be reasoned in writing, explicitly citing the legal provision supporting refusal. Partial access applies where only part of a document is exempt.
Appeal Process
1
Challenge denial through administrative procedures under San Luis Administrative Procedures Law (Ley 5.540)
2
Amparo action before the provincial judiciary
The Defensoría del Pueblo (Office of the Ombudsman) has taken active role enforcing compliance — issued a 2024 resolution (No. 38) compelling provincial agencies to comply with information access obligations under Ley V-0924-2015.
