15 business days from receipt of request (Art. deadline per published regulation). A single extension of 15 additional business days is permitted with written justification communicated before the initial deadline expires. If the OAIP upholds a complaint against an agency, that agency has 15 business days to deliver the information after receiving the OAIP summons. Replaced Decree 1169/2005 which covered only the executive branch.

    Classified or reserved information under specific legislation
  • Financial system
    Financial system data protected under banking secrecy law
  • Trade secrets
    Trade secrets and commercial information causing competitive harm
  • Investigative
    Active investigation materials where disclosure would obstruct proceedings
  • Personal data
    Personal data where anonymization is technically impossible
  • Professional privilege
    Information subject to professional secrecy (medical, legal, etc.)

Exemptions explicitly do not apply to grave human rights violations, genocide, war crimes, or crimes against humanity — these must be disclosed regardless. All exemptions must be applied narrowly and the public interest override must be weighed before denial.

Appeal Process

File complaint with the Oficina de Acceso a la Información Pública (OAIP). OAIP must resolve within 15 business days and notify both requester and agency.

Amparo (constitutional protection) action before the judiciary. No requirement to exhaust administrative remedies first.

Law 11.191 created the Oficina de Acceso a la Información Pública (OAIP) within the executive branch, directed by a competitively-selected official with a 5-year term renewable once. OAIP decisions that favor the requester are binding on agencies.
