Article 20: requests must be submitted in writing or electronically, clearly indicating specific details of information requested, without motivation or formality. Any natural or legal person may request.

Fees

Access to public information is free. Public institutions may only charge for actual reproduction costs, which must be previously established by each institution.

Exemptions

  • State Security
    Information guaranteeing integrity, stability, and permanence of the State, without negatively affecting human rights
  • Criminal Investigations
    Reserved investigations regarding prevention, investigation, or prosecution of crimes or administration of justice
  • International Relations
    Information related to conduct of negotiations and international relations
  • Economic and Political Stability
    Information affecting economic, financial, or monetary stability or governability
  • Personal and Confidential Information
    Sensitive personal data including ethnic/racial origin, physical/moral/emotional characteristics, contact info, political participation, religious beliefs, health, heritage, honor, privacy

Reserved information (información reservada) classified for up to 10 years when disclosure would cause greater harm than public interest. Harm test required under Article 24. The controversial "Law of Secrets" (Decree 144-2014) creating 25-year "ultra secret" classification was repealed in March 2022. RTI Rating: 84/150.

Two-tier system: (1) administrative appeal to IAIP within 10 business days of denial, IAIP decides within 10 days; (2) constitutional amparo to courts after IAIP decision.
