Summary

The Hungarian Prosecution Service exercises legality supervision (törvényességi felügyelet) over all penal institutions under Act CLXIII of 2011 and Act CCXL of 2013. Prosecutors may inspect prisons at any time, review all records relating to the lawful execution of sentences, and order remedial action; persistent unlawfulness must be referred to a court. The Prosecutor General (Legfőbb ügyész) is elected by a two-thirds parliamentary majority for a nine-year term and may not be removed before the term ends except for cause via parliamentary action. The service submits annual reports to Parliament. It has no direct discipline authority over prison staff — misconduct findings are referred to the competent disciplinary or criminal authority. All members are career prosecutors; no civilian composition requirement exists.
