Summary

The Inspectoría General de Seguridad Pública (IGSP) was established by Decreto N° 815 of October 2, 2014, replacing the former internal inspectorate housed within the PNC and transferring it to the Ministry of Justice and Public Security. The Inspector General is appointed by the President of the Republic from a terna of three candidates proposed by the Justice Minister after consulting the Attorney General and the PDDH Procurador; the term is three years. The IGSP has its own budget and legal personality (Art. 2) but operates under ministerial authority, limiting structural independence. Under Art. 5, it exercises functional direction over all PNC and ANSP disciplinary investigations and may initiate proceedings for serious (graves) and very serious (muy graves) offenses — making its disciplinary role effectively binding in the sense that it, not the agency, directs the disciplinary investigation process. All PNC and ANSP units must provide information and documentation upon request (Art. 8), though the statute does not grant formal subpoena or compel-testimony authority equivalent to a court. No civilian composition requirement applies to the Inspector General post. Public reports are submitted to the Ministry; no requirement for independent publication was identified in the statute.
