Summary
Established by Law of 22 September 2008. The Commissioner is appointed by the President with consent of Majlisi Namoyandagon for a 5-year term (maximum two consecutive terms) and is formally independent of state bodies. The Commissioner may freely visit all places of detention, request documents and information from any state body including police and prison administration, and consider individual complaints. In practice the office has very limited impact: fewer than 2% of torture/abuse complaints are resolved, and the office does not independently investigate use-of-force incidents, instead referring findings to the Prosecutor General. No civilian membership requirement applies to this single-person institution. Annual reports are published.
