Law Enforcement Oversight

Who watches the police?

Delaware's primary statutory LE oversight mechanism is the Police Officer Standards and Training Commission (POST, 11 Del. C. ch. 84, reestablished by HB 206 in 2023), which decertifies officers for misconduct, issues subpoenas for hearings, and mandates that all police departments establish local accountability committees. In 2025, Governor Meyer signed SB 4 creating the independent Office of the Inspector General (29 Del. C. ch. 90E), with jurisdiction over all state agencies—including the Delaware State Police and Department of Correction—subpoena authority, and a for-cause removal standard. Civilian review at the local level remains hamstrung by LEOBOR (11 Del. C. ch. 92), which shields most misconduct records. There is no statewide corrections-specific oversight board.
