Delaware POST Commission
Summary
Established under 11 Del. C. ch. 84 and reconstituted by HB 206 (2023) from the former Council on Police Training, the Commission sets minimum training standards, issues and revokes officer certifications, and conducts decertification hearings with subpoena authority. Three of its 17 members must be civilians (non-LE) appointed by the Governor on recommendations from the NAACP, Delaware Center for Justice, and other nonprofits; LE agency heads fill remaining seats as ex officio members. The Commission's decertification decisions are binding; it does not independently investigate use-of-force incidents but receives mandatory investigation narratives post-hearing under 11 Del. C. § 9210.
