Summary

The South Dakota Corrections Commission is established by SDCL 1-15-1.13 as a 9-member advisory body assigned to the Department of Corrections. Three members are appointed by the Governor (from Industry and Commerce, SD Retailers, and labor nominees); two senators (one per party) are appointed by their caucus leaders; two representatives (one per party) similarly; and two members are appointed by the Chief Justice of the Supreme Court. All members serve at the pleasure of their appointing authority. The commission meets at least twice per year at the call of the DOC secretary or chair. Its statutory mandate is to examine criminal justice issues, develop policy initiatives, and approve expenditures from the prison industries revolving fund beyond routine operating costs. It has no independent investigative authority, cannot discipline corrections staff, and relies on DOC for records and information.
