Summary
Va. Code §9.1-601 (effective July 1, 2021) authorizes — but does not require — any Virginia locality to establish a civilian oversight body for its police department. Where established, boards may receive and investigate complaints, review UOF incidents and in-custody deaths, review internal investigations, and issue binding disciplinary determinations including termination. Current sworn officers are barred from membership (retired officers may serve as nonvoting ex-officio advisors). Boards may apply to circuit court for subpoenas when voluntary cooperation is refused. The statute explicitly excludes sheriff's offices, leaving them without a civilian oversight mechanism at the state-enabling level.
