Summary
The Defensoría del Pueblo is Ecuador's national human rights ombudsman, established under Articles 214-216 of the 2008 Constitución Política and governed by the Ley Orgánica de la Defensoría del Pueblo. The Defensor or Defensora del Pueblo is selected through a merit-based public competition organized by the CPCCS (Consejo de Participación Ciudadana y Control Social) for a five-year term, renewable once. The institution forms part of Ecuador's Transparency and Social Control function alongside the Contraloría and Superintendencias. The Defensoría investigates complaints against public authorities and entities providing public services, promotes and monitors observance of human rights and international humanitarian law, and may bring constitutional actions. Its recommendations are not legally binding but carry significant persuasive authority. Annual reports are published and presented to the National Assembly.
