AFA
Summary
The Agence francaise anticorruption (French Anti-Corruption Agency) was created by the Sapin II law (loi 2016-1691 du 9 decembre 2016) and replaced the Service central de prevention de la corruption (SCPC). The Director is appointed by decree of the President of the Republic for a single non-renewable 6-year term and may not be removed before the end of that term. The AFA has three core missions: advising public bodies and private companies on anti-corruption compliance; controlling the implementation of anti-corruption programs required of large companies and public bodies under the Sapin II law; and coordinating the National Anti-Corruption Plan. Under loi 2016-1691, AFA agents have statutory powers to summon individuals, request documents, and access all relevant records. AFA publishes reports and recommendations; pre-publication review of reports addressed to controlled entities is advisory (the entity may comment but the AFA is not bound by those comments). The AFA's budget is set within the Prime Minister's appropriations envelope and is subject to executive discretion.
