Summary

The MNPT is a National Directorate attached to the Defensoría del Pueblo with functional and decisional independence, created by Ley 6 of February 22, 2017, to fulfill Panama's OPCAT obligations following ratification in 2011. Operational since September 2018, it has statutory authority for unannounced visits to all places of deprivation of liberty including police stations, prisons, and psychiatric hospitals; full access to facilities, records, and private interviews with detainees. It issues recommendations to authorities to prevent torture and improve detention conditions. Ley 504 of December 2025 consolidated the MNPT further within the Defensoría's structure. The Director and Deputy Director are appointed by executive decree for five-year renewable terms.

Jurisdiction scope

All places of deprivation of liberty including police stations, prisons, jails, psychiatric hospitals, and any place where persons cannot leave of their own will; mandated unannounced visits and recommendations to prevent torture and cruel, inhuman or degrading treatment.
