Summary

The Boise OPA is established by Boise City Code § 2-10 and provides independent external civilian oversight of the Boise Police Department, separate from BPD's internal affairs. It independently investigates critical incidents — defined to include any use of force resulting in death or serious bodily injury requiring hospital admission — as well as complaints against officers. The Director and staff exercise full independence in their duties; no person may attempt to unduly influence them. BPD officers and city employees must cooperate as a condition of employment. The OPA's discipline recommendations are advisory; it cannot directly impose discipline. BPD retains custody of BWC footage and police reports provided to the OPA, and the OPA cannot release such materials without written BPD approval (restricted evidence access). The director is a civilian appointed by and serving at the will of the mayor.
